Terms of service

Draft. These terms cover the website, the invite wait-list, and the alpha as it runs today, and are pending review by counsel. The full platform terms, with the five founding promises written into them, arrive with that review; until then, this is the honest interim version.

Short, because the alpha is small: who may join, what alpha software means, whose writing it is, and which law applies.

1. What these terms cover

The povesta.ink website, the invite wait-list, and access to the invite-only alpha at app.povesta.ink — operated by nobrainer.zone s.r.o. (details on the imprint page). By using the site or the alpha you agree to these terms.

2. Who may join

povesta is 18+. The alpha is invite-only; an invite is personal and not a thing to resell or transfer.

3. What “alpha” means, honestly

Early software, run with care but offered as available: features may change, break, or be reset, and access may be paused for maintenance. Paid features are off during the alpha — no purchases, no real money moves through the platform. Before that changes, these terms change first, with notice.

4. Your writing stays yours

Nothing in these terms transfers ownership of your writing to us. You grant us only the license needed to run the platform: hosting, displaying, and distributing your work to its readers on povesta. Reader votes steer the story, but a vote confers no authorship, ownership, or compensation interest in any work. The economics (revenue shares, publishing rights, reversion) live in the author contract, which is drafted in the open, and the five founding promises ship inside the final terms. On erasure and data handling, the privacy notice applies.

5. House rules

Use the platform lawfully and don’t spoil it for others:

  • no manipulating votes;
  • no scraping or harvesting other users’ data;
  • no impersonation;
  • no posting content you have no right to post;
  • AI-assisted images carry the provenance label the platform provides.

We may suspend or revoke alpha access that breaks these rules; where practical, we warn first.

6. Our material

The site’s text, design, and the platform itself are ours or licensed to us. Read, quote, and link freely; don’t pass our material off as yours or rebuild the service from it.

7. Liability

To the extent the law allows: the alpha is provided as-is, without warranties; we are not liable for indirect or consequential losses, including lost profits, lost audience, or lost data; and our total liability under these terms is limited to the amounts you have paid us for the service in the year preceding the event giving rise to the claim. We are not responsible for events outside our reasonable control. Nothing in this section limits liability that cannot lawfully be limited, including intent and gross negligence, and the mandatory consumer protections of the country where you live remain untouched.

8. Leaving

You can leave at any time: export your data and ask for erasure per the privacy notice. If we ever discontinue the alpha, we announce it and leave time to export. If we revoke access under the house rules, export and erasure rights still apply.

9. Law and disputes

Czech law governs, without displacing mandatory consumer protections of the country you live in. Consumer disputes can go to out-of-court resolution with the Czech Trade Inspection Authority (ČOI, adr.coi.cz). Czech courts have jurisdiction otherwise — though if you are a consumer in the EU, nothing here deprives you of the courts of the country where you live.

10. Changes

These terms are versioned per language; material changes are announced to alpha accounts by email before they take effect.
